These Terms and Conditions (“Terms”) govern access to and use of the website gate.education (the “Website”) and any services, programs, consulting, coaching, events, digital content, and related offerings provided by GATE – German Academy for Technology & Entrepreneurship (“GATE”, “we”, “us”, “our”).
By accessing the Website, submitting an enquiry/application, creating an account (if applicable), purchasing any service, or participating in a program, you agree to be bound by these Terms. If you do not agree, do not use the Website or Services.
1) Definitions
Client / You: Any user of the Website and/or purchaser/participant of Services.
Services: All offerings by GATE, including but not limited to career guidance, job placement coaching, higher education consulting (Germany/EU), exchange programs, language courses, workshops, events, and digital resources.
Program: Any fixed-duration cohort, exchange, workshop, or coaching engagement offered by GATE.
Digital Content: Templates, documents, videos, recorded sessions (if any), guides, checklists, and other materials.
Third Parties: Universities, employers, visa authorities/consulates, payment providers, partners, venues, and platforms.
2) About GATE and contact
The Website and Services are operated by Arvi Ventures UG. Contact: arvi@gate.education
3) Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase Services.
If any Service is offered to minors, participation requires verifiable parental/guardian consent and may be subject to additional conditions.
4) Scope of Services and no guarantee
Informational and coaching nature: Services may include education consulting, coaching, mentoring, document review, interview preparation, and general guidance.
No guarantee of outcomes: Unless explicitly stated in a separate written agreement, GATE does not guarantee: admission to any university/program, scholarships or funding, visas/residence permits, internships/jobs/offers, salary levels, or start dates.
Third-party discretion: Admissions, hiring, and visa decisions are controlled solely by Third Parties. GATE is not responsible for Third Party decisions, policies, delays, or changes.
5) Website use
You agree not to:
- misuse, interfere with, or disrupt the Website,
- attempt unauthorized access to systems/accounts,
- copy, scrape, reverse engineer, or resell Website content except as permitted by law,
- upload or transmit unlawful, harmful, or infringing content.
- We may suspend or restrict access where misuse is suspected.
6) Accounts, communication, and messaging
If accounts, email, WhatsApp/Telegram, or other messaging channels are used:
- you are responsible for maintaining the confidentiality of your login credentials (if applicable),
- you consent to receiving service-related communications electronically (email, messages, platform notifications),
- marketing communications will be sent only where legally permitted and can be opted out.
7) Orders, pricing, and payment
Pricing: Prices are shown on the Website or in an official written quote. Prices may be subject to VAT/taxes depending on your location and GATE’s tax status.
Payment: Payment must be completed using approved methods (e.g., card, bank transfer, other providers shown at checkout).
Currency: Unless stated otherwise, prices are in EUR. Payment provider terms: Payments may be processed by third-party payment providers, whose terms also apply.
8) Consumer rights (EU/EEA/UK) – digital services and withdrawal
If you are a consumer located in the EU/EEA/UK, you may have statutory rights.
Important (digital services/content):
Where you request immediate performance of a service (e.g., coaching starts right away) or immediate access to digital content, you expressly acknowledge that you may lose your right of withdrawal once performance begins or digital access is provided, as permitted by applicable consumer law.
9) Cancellation, rescheduling, and refunds (general framework)
Unless a specific Program/service page, invoice, or written agreement states otherwise, the following applies:
9.1 Coaching / consulting sessions
Rescheduling: A session may be rescheduled if requested at least 24 hours in advance (or your chosen policy). Late rescheduling or no-shows may be treated as used. Client readiness: If you repeatedly fail to provide required information/documents, GATE may pause delivery until you comply; timelines may shift accordingly.
9.2 Programs (cohorts, exchanges, workshops)
Client cancellation: Refund eligibility depends on the time before the start date and committed third-party costs (venues, hotels, tickets, partner fees). Non-refundable deposits may apply. Overall, in general, all services are non-refundable once begun.
GATE cancellation: If GATE cancels a Program, you may receive either (a) a full refund of fees paid to GATE for that Program, or (b) a credit to another Program—unless cancellation is caused by Force Majeure (see Section 16).
9.3 Non-refundable items
Unless required by law, the following are typically non-refundable once delivered:
- completed document work product (e.g., customized CV/SOP drafts),
- digital materials once accessed/downloaded,
- third-party fees (visa fees, university application fees, courier fees, travel/insurance).
10) Client obligations and accuracy of information
You agree to:
- provide complete, accurate, and truthful information and documents,
- ensure documents submitted are authentic and lawfully obtained,
- meet deadlines and follow instructions where required.
- GATE may refuse or terminate Services if fraud, document forgery, or serious misconduct is suspected.
11) Higher education consulting limitations
GATE may assist with program selection and application preparation, but:
- final submission responsibility remains with you unless you expressly authorize GATE in writing to submit on your behalf (where permitted),
- you are responsible for verifying university requirements and deadlines,
- translation/notarization/legalization (if needed) may require third-party providers; costs are typically paid by you.
12) Career guidance / job placement limitations
GATE may provide coaching, job search strategy, application support, interview prep, and referrals.
- Any “partner company” introductions are discretionary and depend on eligibility, hiring demand, and fit.
- Employment contracts are between you and the employer only; GATE is not a party to employment terms.
13) Intellectual property
- Ownership: All Website content and GATE materials (including templates, frameworks, videos, slides, course materials, brand assets) are owned by GATE or licensors and protected by IP laws.
- License: You receive a limited, non-exclusive, non-transferable license for personal use solely for participation in Services.
- No resale/sharing: You may not reproduce, distribute, sell, sublicense, or share materials publicly without written consent.
14) Confidentiality
GATE may receive personal and sensitive information (education history, employment history, immigration plans). GATE will handle personal data in accordance with the Privacy Policy.
15) Testimonials and results
Any testimonials, examples, or case studies shown on the Website represent individual experiences and do not guarantee similar outcomes. Results vary based on background, effort, market conditions, and third-party decisions.
16) Force Majeure
GATE is not liable for failure or delay caused by events beyond reasonable control, including but not limited to natural disasters, pandemics, strikes, war, government actions, visa policy changes, platform outages, or partner cancellations. In such cases, GATE may offer rescheduling or credit where reasonable, subject to non-recoverable costs.
17) Disclaimers
To the maximum extent permitted by law:
- the Website and Services are provided “as is” and “as available”,
- GATE disclaims all warranties not expressly stated, including fitness for a particular purpose and non-infringement,
- GATE does not provide legal advice; immigration and legal matters should be verified with qualified professionals and official authorities.
18) Limitation of liability
To the maximum extent permitted by law:
- GATE will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, opportunities, or reputation.
- GATE’s total liability arising out of or related to Services will not exceed the amount you paid to GATE for the specific Service giving rise to the claim during the 3 months preceding the event (adjust the cap to your preference), except where liability cannot be limited by law (e.g., intent, gross negligence, death/personal injury, mandatory consumer rights).
19) Indemnity
You agree to indemnify and hold GATE harmless from claims, damages, and expenses arising from:
- your breach of these Terms,
- your misuse of the Website,
- your submission of fraudulent or infringing documents,
- your violation of laws or third-party rights.
20) Termination
GATE may suspend or terminate your access to the Website or Services immediately if:
- you breach these Terms,
- you engage in abusive behavior toward staff/participants,
- fraud or unlawful conduct is suspected,
- you fail to pay fees due.
Termination does not affect accrued rights and obligations, including payment obligations for services already delivered.
21) Changes to these Terms
GATE may update these Terms to reflect changes in Services, legal requirements, or operations. Updates will be posted on the Website with the “Last updated” date. Continued use after changes indicates acceptance.
22) Governing law and dispute resolution
Governing law: Laws of the Federal Republic of Germany.
Jurisdiction: Berlin, Germany—unless mandatory consumer-protection rules require otherwise for consumers. “Parties will attempt to resolve disputes amicably before court proceedings.”
23) Severability
If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
24) Entire agreement
These Terms, together with the Privacy Policy, Cookie Policy, and any program-specific terms displayed at checkout or in a written agreement, constitute the entire agreement between you and GATE regarding the Website/Services.
